Law is a delightful exercise in learning the age-old lesson of PEOPLE ARE STUPID, LET US LAUGH AT THEM.
El was telling me about this case in Malaysia where it was held that longhouses (LONGHOUSES I ASK YOU) are CHATTELS and not FIXTURES. I LAUGHED SO HARD. Okay, I probably sound like a huge dork for this, but chattels are essentially MOVEABLE GOODS, and fixtures are IMMOVABLE GOODS. A LONGHOUSE IS ... WELL... I WOULD SAY HELL IT'S A FIXTURE FOR SURE but NOOOOOO, apparently they can be MOVED and are thus CHATTELS. This is like saying that the Empire State Building can be moved and therefore is in the same category of goods/property as, SAY, A TELEVISION SET.
OKAY I SOUND LIKE A RIGHT DORK, BUT I REALLY LOVED THIS. ♥
And CONTRIBUTORY NEGLIGENCE. Basically it's the principle that goes, if you're responsible for at least SOME of the harm that happeend to you, then the other side doesn't pay as much damages. This happens when, as in one case, TWO PEOPLE GOT VERY DRUNK and decided to race cars. The other version of this is a case which our teacher introduced us to as "Like the one above... BUT IN A PLANE". In other words, DRUNK PEOPLE GET INTO A PLANE AND GO CRAZY RECKLESS JOY-FLYING.
I think I have a love/hate relationship with my Company Law tutor, when sometimes I'm OH GOD WHY WHY WHY and other times I'm HEY SHE'S NOT SO BAD. Yesterday, in our tutorial class, she was talking to one of my classmates (in an Eastern European language), and then she smiled and translated what they'd said for us - my classmate had recently learned that she was expecting, and looked really happy. We were all CONGRATULATIONS!!! and I thought about how precious and wonderful life is, and that sometimes we get so lost in work and what we're going to do, be it school or work, and we forget that life is so much more than university and what grades we get and what jobs we do. I always feel that way in the presence of babies when I'm in hospital, I look at them and I realise how vast the world is, and I feel so humbled and awed by these great things in life. When I look at a baby I think, this is human life, this is where we came from, and this is our future. (Okay, I'm not being very coherent, but these thoughts are so hard to express in words) I worked in a clinic once, and it's when you see really ill people that you realise how precious life and health is. But when I see babies I feel it so strongly - it gives me such a sense of perspective, and makes you feel that life is a gift, that being alive is itself a reason for joy.
I came in to the library and was WHAT? THERE ARE NO QUESTIONS FOR OUR Intellectual Property Law TUTORIAL?! I DISLIKE NOT HAVING QUESTIONS TO ANSWER FOR TUTORIALS. IT'S JUST READING AND IT IS NOT ENOUGH. Tomorrow I have a meeting with my Personal Tutor and it's supposed to be the usual meeting to ensure that ALL THE STUDENTS are well-prepared for the exams. WELL EXCUSE ME BUT IT'S A BIT LATE NOW ISN'T IT IF WE WEREN'T? But we're going to have a Company Law Revision seminar next Wednesday, so I'm happy! *grin*
